The minute a police car is behind you, you are being investigated for DWI.

Watch how you park. (It matters)
.07 still gets you arrested for DWI.
Even if under the legal limit, you can still be charged.

Police look at the following to use against you

  •  your eyes - for bloodshot eyes
  •  how your'e dressed
  •  if you are descheveled
  • if they smell liquor
  • if your shirt is untucked
  • how you parked the car
  • how you drove the car
  • how long does it take to find drivers license?
  • how long does it take to find your insurance documents?
  • how long does it take to find registration?
  • how long does it take to hand over the documents?
(being nervous does not count in your favor)

it looks to the law as evidence that you are impaired by alcohol, not nervous

If you open your mouth (this can and will be used against you) the only thing that should come out is: I would like to speak to an attorney!!!, better yet, hand them a card from an attorney you carry with you that says:

This request cannot be used against you!

This stops police from doing field sobriety test, and all other tests police do to see if you are impaired by alcohol or drugs.


If you say anything else, like the following, you may be in big trouble!
  • police smelling your breath
  • police looking for slurred speech
  • police looking for stuttering speech
  • police looking for staggering speech
